Prompty

1. Acceptance of Terms

By accessing or using Prompty, you agree to be bound by these Terms of Use. If you disagree with any part of these terms, do not use the service.

2. Eligibility

You must be at least 16 years old to use Prompty. By using the service, you represent that you meet this requirement.

3. Account Responsibilities

• You are responsible for keeping your account credentials secure.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

4. User Content & License

You retain ownership of the content you create on Prompty. By submitting content, you grant Prompty an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, modify, create derivative works from, distribute, publicly display, sublicense, and use for AI/ML training — for any purpose.

You represent that you have the right to grant this license. Prompty may remove content that violates these terms.

5. Acceptable Use

You must not:

• Violate any applicable laws or regulations.
• Infringe on the intellectual property rights of others.
• Upload malicious code or interfere with the service.
• Abuse, harass, or threaten other users.
• Attempt to gain unauthorized access to the service or its systems.
• Scrape, overload, or otherwise disrupt the service.

Prompty may suspend or terminate accounts that violate these rules.

6. Public Content

Content you mark as public is visible to all users along with your username. You are responsible for what you make public. Prompty is not obligated to monitor public content but may remove it at its discretion.

7. Intellectual Property

The Prompty name, logo, design, and code are the property of Equites Digital. You may not copy, modify, or distribute Prompty's intellectual property without prior written permission.

8. Third-Party Services

Prompty relies on third-party services including Clerk, Neon, Vercel, and potentially OpenRouter, Google ReCaptcha, and Paddle. We are not responsible for their availability or practices. Your use of Prompty is also subject to their respective terms.

9. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We make no guarantee of uptime, accuracy, or fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, Equites Digital is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability is capped at the amount you paid us in the 12 months preceding the claim (or €0 if you are on the free tier).

11. Termination

Either party may terminate at any time. You can delete your account via your Settings page. Prompty may suspend or terminate accounts that violate these terms.

The following sections survive termination: User Content & License, Disclaimers, Limitation of Liability, and Governing Law.

12. Governing Law

These terms are governed by the laws of Belgium. Any disputes are subject to the exclusive jurisdiction of the courts of Flanders, Belgium.

13. Changes to These Terms

We may update these terms from time to time. Changes are effective when posted on this page. Continued use of the service after changes constitutes acceptance of the updated terms.
