1. Who We Are

Prompty is operated by Equites Digital, based in Flanders, Belgium.

2. What Data We Collect

• Account data — provided via Clerk: email address, username, and session information.
• Content — prompts, personas, tones, output formats, and constraints you create.
• Interaction data — votes, favorites, and timestamps associated with your activity.

3. How We Use Your Data

• Provide and operate the service.
• Display public content to other users.
• Improve the service and develop new features.

We do NOT sell your personal data.

4. Third-Party Services

We use the following third-party services:

• Clerk — Authentication. Receives your email, username, and session data.
• Neon — Database hosting. Stores all user content and account references.
• Vercel — Application hosting and cookieless analytics. Receives standard request data (IP, user agent).
• OpenRouter (future) — Prompt improvement. May receive prompt content you submit for enhancement.
• Google ReCaptcha (may be added) — Bot protection. May receive IP address and browser signals.
• Paddle (may be added) — Payment processing. Would receive billing and payment information.

5. Public Content & Visibility

Content you mark as public (personas, tones, output formats, constraints) is visible to all users along with your username. You control whether each item is public or private. Saved prompts are private by default.

6. Content License

You retain ownership of the content you create on Prompty. By submitting content, you grant Prompty an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, modify, create derivative works from, distribute, publicly display, sublicense, and use for AI/ML training — for any purpose.

7. Cookies & Analytics

• Clerk session cookies — essential for authentication. Cannot be disabled.
• Vercel Web Analytics — cookieless, collects no personal data.
• We do not use advertising or tracking cookies.
• If Google ReCaptcha is added in the future, it may set its own cookies.

8. Data Retention & Deletion

You can delete your account and data through your Settings page. Deletion is immediate. Data may persist in backups for a limited period.

You may also request deletion by emailing privacy@prompty.tools.

9. Children's Privacy

Prompty is not directed at users under the age of 16. We do not knowingly collect personal data from anyone under 16. If you believe a child has provided us with personal data, please contact us so we can remove it.

10. Your Rights (EEA)

Under the GDPR, you have the right to:

• Access your personal data.
• Rectify inaccurate data.
• Request erasure of your data.
• Restrict processing of your data.
• Data portability.
• Object to processing.

Our legal bases for processing are consent and legitimate interest. You have the right to lodge a complaint with your local data protection supervisory authority.

11. Your Rights (California)

Under the CCPA, California residents have the right to:

• Know what personal data we collect and how it is used.
• Request deletion of personal data.
• Opt out of the sale of personal data — we do not sell your data.
• Non-discrimination for exercising your rights.
